EtaFinance Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a binding legal agreement between you and the operator(s) of EtaFinance ("we," "us," or "our"). These Terms govern your access to and use of EtaFinance (the "Application"), a non-custodial smart contract-based protocol that facilitates decentralized exchange of digital assets.

By accessing or using the Application, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Description of Services

EtaFinance provides software that enables users to interact with decentralized blockchain protocols and smart contracts. You acknowledge and agree that:

• The Application is provided "as is" and remains in an experimental phase.
• Use of the Application involves significant risks, including but not limited to loss of funds, failed transactions, and unintended smart contract behavior.
• You are solely responsible for the security of your wallets and private keys.
• Any tokens used within the Application ecosystem are not legal tender and may fluctuate in value or become worthless.
• You use the Application at your own risk.

3. No Custody; No Advice

• EtaFinance does not custody digital assets or operate as a financial intermediary.
• The Application does not access, control, or manage user funds at any time.
• No part of the Application or related materials constitutes legal, financial, tax, or investment advice.
• You are solely responsible for conducting your own due diligence before using the Application or interacting with any supported blockchain protocol.

4. User Obligations

By using the Application, you agree to:

• Maintain sole control of your wallet credentials and private keys;
• Ensure your actions comply with all applicable laws and regulations in your jurisdiction;
• Only use digital assets that you lawfully own or control;
• Pay all applicable network and gas fees related to your use of the Application;
• Accept that we do not provide asset recovery services.

5. Prohibited Activities

You may not use the Application to:

• Violate any applicable law or regulation, including those related to anti-money laundering (AML), counter-terrorist financing (CTF), or economic sanctions;
• Transmit or facilitate unlawful, fraudulent, or harmful activity;
• Interfere with or disrupt the functionality, performance, or integrity of the Application or related systems.

6. Sanctioned Jurisdictions

Access to or use of the Application is prohibited for individuals or entities that are:

• Located in, incorporated in, or resident of jurisdictions subject to U.S. or other applicable sanctions, including without limitation: Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine;
• Designated on any sanctions list maintained by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC) or other relevant authorities.

We reserve the right to restrict or terminate access where legally required or where use violates sanctions compliance obligations.

7. Restricted U.S. Jurisdictions

The Application is not offered to any U.S. state or territory in which the use of the Application would be unlawful or would require us to register, license, or otherwise comply with regulatory requirements. You represent that you are not a resident of any such jurisdiction.

8. No Warranty

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. WE EXPRESSLY DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We make no representations or warranties regarding:

• The reliability or availability of the Application;
• The accuracy or completeness of information provided by the Application;
• The security or integrity of the smart contracts;
• The ability to recover or reverse transactions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APPLICATION, INCLUDING BUT NOT LIMITED TO:

• LOSS OF FUNDS OR DATA;
• FAILED TRANSACTIONS OR CONTRACT EXPLOITS;
• UNAUTHORIZED ACCESS TO YOUR WALLET OR PRIVATE KEYS;
• REGULATORY ACTION OR PENALTIES.

OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100), EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

10. Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY CLAIMS OR DISPUTES ARISING UNDER THESE TERMS WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION.

11. Modifications

We reserve the right to modify, suspend, or terminate the Application or these Terms at any time without prior notice. We will post the updated Terms with a new "Last Updated" date. Continued use of the Application after such posting constitutes acceptance of the changes.

12. Governing Law

These Terms and any disputes related to your use of the Application shall be governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to conflict of law principles.

13. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.
